A K1 visa is a visa for one’s fiancé(e) to enter the United States. In order to apply for a K1 visa the couple must be engaged to be married and the marriage must be considered legal under the laws of the state in which they intend to live. In order for a K! visa to be issued, the couple must have met face to face at least once in the two years immediately preceding the K1 Visa application. However, there are exceptions to this requirement for a K1 Visa because there are cultures in which the man and women are not permitted to meet before the marriage ceremony.
In order to obtain a K1 Visa for one’s fiancé (e), you do have to be an American citizen and live in the United States. The process of obtaining a K1 visa starts with an application for Petition of Alien Fiance(e) in the United States. This petition to start the proceedings for a K1 visa is Form -129F, which has to be filed with the Department of Homeland Security. Under the same petition, you can obtain a K1 Visa for the fiance(e)’s children to come to the US as well. You cannot file a petition or application for a K1 Visa at an embassy or consulate office.
Once Homeland Security approves the petition, the application then goes to the National Visa Center and then the US fiancé will complete the application for the K1 Visa. Although the approval of the petition will allow for the issuing of a K! Visa, this approval is valid for only four months. The K1 visa requirements and paperwork have to be completed within that time frame or you will have to restart the process. You and your fiance(e) must also agree to marry within 90 days after he/she enters the country or the K1 visa could be revoked.
Because a KI Visa essentially gives a person from another country permission to enter the United States, certain requirements must be met. This person must already hold a valid passport to be considered eligible for a K1 Visa. The expiry date on the passport must also be sufficient to allow for a six-month stay in the US. If not, in order to get a K1 Visa, the person must complete the paperwork to receive a new passport in his/her home country. A birth certificate is also required, as well as police certification, documentation detailing financial support when in the US, a medical examination and several references. Without these documents, a K1 Visa will not be approved.
